boomurl — Terms of Use

Read this first. BoomURL is a free, ad-supported hosting service provided as-is. By publishing or viewing content you accept these Terms in full. BoomURL reserves the right to remove any content, suspend or terminate any account or site, and refuse service to anyone — for any reason or no reason, at any time, without notice, and without liability to you.

1. Acceptance of These Terms

These Terms of Use ("Terms") are a binding agreement between you and the operator of boomurl.com and boomurl.site ("BoomURL", "we", "us"). By accessing boomurl.com, publishing a site, or viewing any content served under boomurl.site, you accept these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority where you live) to publish content. By publishing you represent that you meet this requirement and that you have the legal right to publish everything you upload.

2. The Service

BoomURL lets you upload static web content (the "Content") and serves it at a path under boomurl.site. The Service is provided free of charge, supported by advertising that we inject into served pages. We may modify, suspend, limit, or discontinue the Service — in whole or in part — at any time, without notice.

The Service exists for one purpose only: hosting small, human-viewable websites. It is not a file locker, backup service, data store, content delivery network for other sites, or transport mechanism of any kind.

3. Your Content and Your License to Us

You retain ownership of your Content. You grant BoomURL a worldwide, non-exclusive, royalty-free, sublicensable license to store, reproduce, cache, transmit, distribute, publicly display, and technically modify your Content as needed to operate the Service — including rewriting paths and URLs, compressing or transcoding files, caching at edge servers, and injecting advertising or service notices into served pages. This license ends when your Content is deleted, except for cached copies that expire in the ordinary course and copies we retain as required by law or for abuse investigation.

You are solely responsible for your Content and for keeping your own copies. We provide no backups and have no obligation to retain, return, or recover any Content — deletion (by you, by us, or by failure) is permanent.

4. Prohibited Content

Publishing any of the following will result in removal and may result in a ban:

  • Sexual content— pornography or sexually explicit material of any kind. Any sexual or suggestive content involving minors is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement — zero tolerance, no exceptions.
  • Hate and violence — hate speech; content that demeans, threatens, or dehumanizes any person or group; depictions or glorification of violence; incitement to violence; terrorist or violent-extremist content; instructions for causing harm.
  • Malicious code — malware, viruses, trojans, ransomware, spyware, cryptocurrency miners, exploit code, drive-by downloads, browser or device exploitation, deliberately obfuscated code whose purpose cannot be determined, or code that degrades or attacks any system, including ours.
  • Phishing and impersonation — fake login or payment pages, credential or personal-data harvesting, impersonation of any person, brand, government, or service, or any page designed to deceive visitors about who operates it.
  • Fraud and scams— scams, fake stores, counterfeit goods, pyramid or Ponzi schemes, cryptocurrency drainers, advance-fee fraud, deceptive "prizes", or any commercial deception.
  • Infringing content — content that violates copyright, trademark, or other intellectual-property or publicity rights, including pirated software, media, warez, license-circumvention tools, or links primarily serving infringement.
  • Privacy violations— doxxing, leaked credentials or databases, other people's personal data without consent, or surveillance content.
  • Illegal content and regulated goods — anything illegal where we operate or where you publish from, including unlawful sale of weapons, drugs, or pharmaceuticals, and unlicensed gambling.
  • Spam and manipulation — link farms, doorway pages, cloaking, search-engine manipulation, or pages that exist to redirect, trap, or mislead visitors.
  • Content targeting children — any site directed at children under 13 that collects information from them.

5. Prohibited Uses — Including Data Smuggling

Because the Service serves only human-viewable websites, the following uses are prohibited regardless of how the data is packaged:

  • Storage and transport abuse — using the Service as a file host, blob store, backup target, dead drop, paste service, or data-transfer channel. This includes hiding arbitrary data insidepermitted file types: data appended to or embedded in HTML, CSS, JS, JPG, PNG, GIF, MP4, MOV, or any other format; steganography; base64 or otherwise encoded blobs; encrypted archives renamed as web assets; and data split across files or sites to evade size limits. If a file's primary purpose is carrying data rather than being displayed as part of your website, it is prohibited.
  • Infrastructure abuse — command-and-control endpoints, beacons, exfiltration drop points, proxy/relay pages, or any use of the Service as infrastructure for activity occurring elsewhere.
  • Hotlinking / external CDN use — serving assets primarily to pages hosted outside boomurl.site.
  • Resource abuse— automated or bulk publishing, registering many sites or identities to evade limits, disproportionate bandwidth or storage consumption, or interfering with the Service's operation or security.
  • Ad and monetization abuse — removing, hiding, breaking, or interfering with injected advertising on free sites, or generating fraudulent ad interactions.
  • Evasion — re-publishing removed content, circumventing a suspension or ban, or helping others do so.

We may use automated and manual review — including malware scanning, hash matching, content classification, and traffic analysis — to detect violations. We have no obligation to monitor, and reviewing or not reviewing Content creates no responsibility for it.

6. Removal and Termination — Our Absolute Discretion

BoomURL may remove or disable any Content, suspend or terminate any site or any person's access, and refuse service — at any time, for any reason or no reason, with or without notice, and without any liability to you or anyone else. The lists in Sections 4 and 5 are examples, not limits, of what we may act on. Decisions are final and we are not obligated to explain them. Upon removal or termination, we may permanently delete the associated Content.

7. Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice compliant with 17 U.S.C. § 512(c)(3) to legal@boomurl.com, including: identification of the work, the infringing URL, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your physical or electronic signature. We remove infringing material and terminate repeat infringers. Knowingly false notices may make you liable for damages under 17 U.S.C. § 512(f).

8. Third-Party Content

Sites served under boomurl.site are created by users, not by BoomURL. We do not endorse, verify, or assume responsibility for any user Content. Your interactions with any user site — including any purchase, download, or disclosure of information — are entirely at your own risk.

9. Privacy

To operate the Service we collect and retain: publisher email addresses, IP addresses (at verification, publishing, and serving time), site metadata, and standard server logs. We use this information to operate, secure, and improve the Service, to enforce these Terms, and to comply with legal obligations, and we may disclose it to law enforcement when we believe disclosure is required or appropriate. Served pages include third-party advertising, which may use cookies or similar technologies.

10. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOMURL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY CONTENT WILL REMAIN AVAILABLE, THAT DATA WILL NOT BE LOST, OR THAT THE SERVICE IS FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) BOOMURL AND ITS OPERATORS, OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CONTENT, GOODWILL, OR BUSINESS, ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) BOOMURL'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNTS YOU PAID TO BOOMURL IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. THE EXCLUSIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED IN YOUR JURISDICTION; WHERE A JURISDICTION DOES NOT ALLOW A PARTICULAR EXCLUSION, LIABILITY IS LIMITED TO THE SMALLEST AMOUNT THAT JURISDICTION PERMITS.

12. Indemnification

You agree to defend, indemnify, and hold harmless BoomURL and its operators, owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or any third party's rights. We may assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate.

13. Disputes, Arbitration, and Class-Action Waiver

These Terms are governed by the laws of the State of California, USA, excluding its conflict-of-laws rules. Any dispute arising from these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. YOU AND BOOMURL EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Any claim must be brought within one (1) year after it arises or it is permanently barred.

14. Changes to These Terms

We may revise these Terms at any time by posting the updated version at this URL with a new version date. Continued use of the Service after a revision takes effect constitutes acceptance. Material changes apply to new publishes from the moment of posting.

15. General

These Terms are the entire agreement between you and BoomURL regarding the Service. If any provision is held unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely. We are not liable for failures caused by events beyond our reasonable control. You agree to comply with all applicable export-control and sanctions laws. Sections 3, 6, and 8–13 survive termination.
